Trust Administration
Trust AdministrationA trust is an arrangement where a grantor, sometimes called a settlor or trustor, transfers property to a trustee (who may be themself) for the benefit of one or more designated beneficiaries.  Trusts come in many forms and are designed to serve many purposes.  But no matter its type or purpose, every trust must be managed.  While individuals and trust companies are often able to conduct trust business on their own, the need for an attorney does arise from time to time.  Sometimes, clients need advice on the appropriateness of a particular transaction and help structuring it within the particular trust’s terms.  Other times, those terms have become outdated and must be amended by a court.

Probate & Estate Administration
Probate is the process by which a person’s estate is administered and assets are transferred to beneficiaries under a Will or, if there is no Will, via the laws of descent and distribution.  For many people, probate can be a painful and confusing process to endure after the loss of a loved one.  At Winn, Beaudry & Winn, we understand what it is like to go through this process and we empathize with our clients as we advise them on how to best navigate these troubled waters.  Whether or not your loved one died leaving a Will, you will need a probate attorney to guide you through the probate process.  This may include obtaining Letters Testamentary or Letters of Administration to access any bank, brokerage or retirement accounts, as well as insurance proceeds payable to the estate.  Your attorney will also help you transfer title to real or personal property and file the estate’s inventory and  accountings.  Additionally, you may need your attorney to advise you on tax-related matters.
